1. Accepting these terms
In these terms, "Sumitt", "we", "us" and "our" means the Australian business Sumitt (ABN 30 808 946 085), based in Victoria. By creating an account or using Sumitt, you agree to these terms. If you are using Sumitt for a business, you are agreeing on that business's behalf and confirm you are authorised to do so.
2. What Sumitt is — and isn't
Sumitt is a tool that helps you build, price, send and get paid on quotes, and run the admin around them. It includes recommended starting rates, AI assistance, and ready-made policy wording to save you time.
3. Your responsibility for quotes
You are responsible for every quote and invoice you produce with Sumitt. Before you send one, you must check that the figures, rates, GST treatment, deposit amount and terms are correct and lawful for your job, your state and your business. In particular:
- Rates and quantities are only as accurate as the numbers you set — review them against your own supplier and labour costs.
- Deposits for residential building work are legally capped in most Australian states (commonly 10%). It is your job to keep deposits within the limit that applies to you — Sumitt warns you, but does not enforce it.
- Contract and policy wording must suit your job and may need a solicitor's review for high-value or unusual work.
- GST is applied based on the registration setting you choose; make sure it matches your actual status.
We are not a party to any contract between you and your client, and we are not responsible for jobs quoted, won, lost or carried out using the software.
4. Payments & payouts
Card payments you collect from your clients through Sumitt — both deposits and balance/progress payments — are processed by Stripe. By accepting them you also agree to Stripe's Connected Account Agreement, and you are the merchant of record for those payments: they settle to the Stripe account you connect, and Stripe's processing fees are borne by you. In addition, Sumitt charges a platform fee on each card payment you collect — currently 1.5% + A$0.30 per payment, and always disclosed in-app before the client pays. Funds are paid out to your connected bank account less these fees. You are responsible for the accuracy of your payout details and for any refunds, chargebacks or disputes on your jobs.
5. Trial, plans, billing & cancellation
- New accounts include a 10-day free trial.
- After the trial, Sumitt offers two plans: Core — $39 AUD/month and Pro — $79 AUD/month (annual options may be offered at a discount), billed in advance until cancelled. Prices are in AUD. While Sumitt is not registered for GST, no GST is charged on subscriptions or platform fees; if we register, GST will be shown at checkout from that point.
- Promotional offers (promo codes and the refer-a-mate program) are limited to one per account, apply at checkout to monthly plans only, are not redeemable or exchangeable for cash, and may be changed or withdrawn for new signups at any time — never retroactively for a discount or credit you have already received.
- You can cancel any time from your account; cancellation stops future billing and we do not charge exit fees. Access continues until the end of the paid period.
- If you subscribe through the Apple App Store or Google Play, billing, renewals, refunds and cancellation are managed by that store under its terms — manage or cancel from your store account, not from us.
- Except where required by the Australian Consumer Law (or an app store's policy), fees already paid are non-refundable.
- We may change plan pricing with reasonable notice; changes do not affect the period you have already paid for.
6. Acceptable use
Don't use Sumitt to break the law, infringe others' rights, or attempt to disrupt, reverse-engineer or gain unauthorised access to the service. Keep your login secure — you are responsible for activity under your account.
7. Your data
Your business and quote data remains yours. You grant us the limited rights needed to store, process and display it so we can provide the service (including sending it to the processors named in our Privacy Policy). We handle personal information as described in our Privacy Policy. You can export your data, and you can delete your account and data at any time.
8. Availability
We work to keep Sumitt available and accurate, but we provide it "as is" and can't guarantee it will always be uninterrupted or error-free. We may add, change or remove features over time.
9. Liability
Our services come with guarantees that cannot be excluded under the Australian Consumer Law, and nothing in these terms excludes those rights. To the extent the law allows, we are not liable for indirect or consequential loss, or for lost profit, lost jobs, or pricing decisions you make using the software, and our total liability is limited to the amount you paid us in the 12 months before the claim.
10. Changes & termination
We may update these terms; if changes are material we'll give reasonable notice in the app or by email. You may stop using Sumitt at any time. We may suspend or close accounts that breach these terms.
11. Governing law
These terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of Victoria.
