The rules in Tasmania that Sumitt already knows

Every rule below is read, when this page renders, from Sumitt’s own law tables: the ones the quote builder, the variation composer, the extension-of-time notice and the payment-claim generator run on, and its table of the Security of Payment Acts of the states it builds no claim for. Sumitt warns and never blocks, and the page moves the day a table does.

Deposit cap in Tasmania

The law in Tasmania caps a deposit at 10% of a residential building work contract of $20,000 or more and under $50,000 (Residential Building Work Contracts and Dispute Resolution Act 2016, s 41, and Residential Building Work Contracts and Dispute Resolution Regulations 2016, r 6).

The law in Tasmania caps a deposit at 5% of a residential building work contract of $50,000 or more (Residential Building Work Contracts and Dispute Resolution Act 2016, s 41, and Residential Building Work Contracts and Dispute Resolution Regulations 2016, r 6).

Up to 20% can apply only where more than half the contract value is work done off-site.

Tasmania's deposit cap applies only to a residential building work contract of $20,000 or more. Under $20,000, a deposit of about 10% is common practice, not law. Separate contracts with the same owner that could have been one contract count as one, at the sum of their prices (Residential Building Work Contracts and Dispute Resolution Act 2016, s 8).

Check it applies to your contract.

Sumitt's default deposit is 10% of the total including GST. Sumitt warns you when a deposit goes over the line, and it never changes the deposit you set.

Licence line in Tasmania

Sumitt's licence-line warning covers New South Wales, Victoria and Queensland today. It carries no line for Tasmania, so the licensing rules there stay yours to check.

Security of Payment claims in Tasmania

Tasmania's Building and Construction Industry Security of Payment Act 2009 applies to building and construction contracts, written or oral, and gives a right to progress payments and to serve a payment claim (ss 7(1), 12 and 17).

Sumitt builds the payment claim for New South Wales, Victoria and Queensland today, not yet for Tasmania, so in the app an overdue invoice there runs up the follow-up ladder to the letter of demand.

Variations in Tasmania

In Tasmania the variation rules, ss 17 to 21 of the Residential Building Work Contracts and Dispute Resolution Act 2016, bind a residential building work contract with an owner for a contract price of $20,000 or more (s 9(a)), not a subcontract or a contract with an owner builder (s 4).

Put an agreed variation in writing in the shortest practicable time, and before its work starts where it adds work (s 17(1)), unless the work is urgent and a document first is not reasonably practicable (s 17(2)).

Where a proposed variation is to come into existence when you and the owner sign the variation document, as your first and only agreement for it, and it adds work or the owner asked for it, do no work on it until you and the owner have both signed (s 17(4) and (5)).

The document must be in English and readily legible, describe the variation, give the reason where you sought it, estimate any delay, state the change to the contract price or how it is to be worked out (on a cost-plus contract, a fair and reasonable estimate of its costs), and, where the contract has progress payments, provide for them to reflect the change (s 18(2)).

As soon as practicable after the document is made, sign it and take all reasonable steps to have the owner sign it (s 19). As soon as practicable, and in any case within 5 business days, after you agree to the variation, give the owner a readily legible copy signed by you both, or signed by you alone where you took all reasonable steps to have the owner sign it and the owner has not (s 20).

Where the varied work needs a building surveyor's consent under the Building Act 2016, because it departs from the work a certificate of likely compliance covers, attach the surveyor's written consent to the owner's copy of the variation document, and do no work on the variation until it is attached (s 21(2)). Where the work needs a permit or other authorisation under the Land Use Planning and Approvals Act 1993 or the Building Act 2016, it must be authorised by it (amended if need be), a copy attached to the owner's copy, and no work done on the variation until it is (s 21(3)).

The Act makes these the contractor's duties. Without the variation document you both signed, the price of the extra work is your word against the owner's.

On a contract the Act covers, where a variation is to come into existence when you both sign it, both signatures before any work on an added or owner-sought variation are a statutory element (s 17(4) and (5)), not just good practice. Sumitt flags a running job that has an unapproved variation on it.

Sumitt structures the variation, records your signature as you send it and collects the owner's at the link, a record you keep, not legal advice. Where your contract sets its own variation process, follow it too.

Extensions of time in Tasmania

In Tasmania the contract sets the extension-of-time window. Sumitt's notice defaults to 10 calendar days from the day the delay ended, shows the countdown, and asks you to check the contract's own figure.

A template you serve in your own name, not legal advice. Your contract's own extension-of-time clause governs the window and the grounds, so check it and keep a copy of everything.

Sumitt provides software and templates, not legal, financial or tax advice. Check what applies to your contract.

Built for landscapers

Every figure here is read from the Landscaping rate card, takeoff engine and hazard library inside Sumitt when this page renders, so it cannot say more than the product does.

18 lines in 5 groups, 4 with a grade or billing basis to pick. Size field: Area (m²). Every rate editable.
